Data Ownership & Eligibility
How we assess the right to offer code and business data for licensing.
Last updated: October 26, 2026
Licensing is different from selling ownership
A licence grants defined usage rights under a written agreement. Depending on the agreed terms, the owner may retain ownership, but some buyers may seek exclusivity or other restrictions. You decide whether proposed licensing terms meet your goals.
Who must have authority
Only a person or company with sufficient rights may authorise evaluation or licensing. Before advancing, establish which legal entity owns each asset, whether contractors assigned intellectual property and whether any customers, partners or employers retain rights.
Client work and third-party code
An IT agency does not automatically own code delivered to a client. Contracts may assign all or part of the IP, restrict reuse, or require consent. Open-source dependencies and commercially licensed third-party components may also limit redistribution and sublicensing. We consider rights-cleared company-owned materials first.
Personal, regulated and confidential information
Do not send us personal candidate records, employee data, customer information, confidential client communications, credentials or regulated information through public inquiry forms. Records containing such material may require exclusion, lawful de-identification, documented authority and specialist review before any proposed licensing.
Initial review and buyer disclosure
An initial conversation can begin with a metadata-level description of repositories, age, languages, file types, record volumes, provenance and ownership. Sharing content or granting access to prospective buyers is a later, separate decision requiring appropriate permissions and agreed scope.
Exclusivity and existing obligations
Earlier licences, nondisclosure agreements, customer commitments and exclusivity obligations may prevent or narrow another licence. Check all restrictions before agreeing to new rights. A single asset may be subject to different permissible licensing scopes, but only if the agreements allow it.
Professional review
We can help organise licensing considerations, but we do not replace legal, tax or privacy advice. Consult qualified advisers before licensing valuable or sensitive business assets.
